1. Acceptance of Terms

These Terms govern your use of the Site and all services, features, content or functionality made available via the Site, including but not limited to browsing, registering for an account, submitting content or communications, and interacting with other users. You acknowledge that we may modify or update these Terms at any time in our sole discretion; any such changes will be effective upon posting on the Site, and your continued use after the effective date constitutes acceptance of the updated Terms.
If you do not agree to be bound by these Terms in their entirety, you must immediately cease all access to and use of the Site. These Terms constitute the entire agreement between you and south-africa.university with respect to the subject matter herein and supersede all prior or contemporaneous communications, representations or agreements, whether electronic, oral or written.
2. Description of Service
South African Universities (“Site”) provides comprehensive, up-to-date informational content about South Africa’s higher-education institutions—including detailed profiles, program offerings, admission criteria, tuition information and student resources. While we strive for accuracy and timeliness, you acknowledge that all content is provided “as is” and may contain errors or omissions. We reserve the right, at our sole discretion and without prior notice, to modify, suspend or discontinue any aspect of the Site or its services, features, content or functionality—whether temporarily or permanently. This includes, but is not limited to, adding, removing or editing pages, updating design and layout, changing navigation paths, or altering supported browsers and devices. You agree that South African Universities will not be liable to you or to any third party for any such modification, suspension or discontinuation of the Site.
3. Eligibility
Use of the Site is limited to individuals who are at least 18 years old (or, if higher, the age of majority in your jurisdiction). By accessing, browsing, registering for an account, or otherwise using any portion of the Site, you represent and warrant that you meet this age requirement. If you do not satisfy this requirement, you must immediately cease all use of the Site.
We reserve the right to verify your age at any time and to request documentation to confirm your eligibility. If you cannot provide satisfactory proof of age, we may suspend or terminate your access without notice. Parents or legal guardians who permit minors (aged below the age of majority) to access the Site remain fully responsible for supervising their children’s use and ensuring that such use complies with these Terms.

• Posting content that is unlawful, defamatory, obscene or infringing on third-party rights.
You will not upload, share or distribute any material that:

৹ Constitutes harassment, hate speech, threats or intimidation;
৹ Infringes patents, trademarks, copyrights, trade secrets or other proprietary rights;
৹ Contains viruses, malware or other harmful code;
৹ Is otherwise unlawful, misleading, abusive, libelous, defamatory, obscene or sexually explicit.
• Interfering with or disrupting Site operations.
You must not interfere with the normal operation of the Site, including by:
৹ Attempting to gain unauthorized access to any portion of the Site, other users’ accounts or computer systems;
৹ Overloading, “flooding,” “spamming,” “mail-bombing” or crashing the Site;
৹ Employing any automated means (robots, spiders, scrapers, data mining tools) to access, monitor or copy content without our express permission.
Violation of any of the above may result in immediate suspension or termination of your account, removal of offending content, and potential legal action.
6. Intellectual Property
All content available on the Site—including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software—is the property of South African Universities or its licensors and is protected by South African and international copyright, trademark, and other intellectual property laws.
• Limited License for Personal Use.
You are granted a non-exclusive, non-transferable, revocable license to access and view Site content solely for your personal, educational, non-commercial use.
• Prohibited Uses.
Except as expressly permitted in these Terms or with our prior written consent, you may not:
৹ Copy, reproduce, distribute, publicly display, perform, modify, create derivative works from, or otherwise exploit any portion of the Site;
৹ Frame or inline-link to any portion of the Site without our express permission;
৹ Remove, obscure or alter any copyright, trademark or other proprietary rights notices contained in or on the Site.
• Trademarks.
All South African Universities trademarks, service marks, trade names, logos and slogans appearing on the Site (the “Marks”) are our property or the property of our licensors. You agree not to display or use the Marks without our prior written permission.
• User-Generated Content.
By submitting any text, images or other materials to the Site (e.g., in comments, reviews or forum posts), you grant South African Universities a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute and publicly display such content in any media. You represent and warrant that you own or control all rights in and to the content you submit.
• DMCA and Copyright Infringement.
If you believe any content on the Site infringes your copyright, please notify our designated agent in writing with the information required by the Copyright Act. We will respond expeditiously to remove or disable access to infringing material and terminate repeat infringers’ access in appropriate circumstances.
Any use of Site content other than as set out above violates these Terms and may violate copyright, trademark and other laws, and is strictly prohibited.
7. User-Generated Content
By submitting comments, feedback, reviews, suggestions, ideas, or other content (“Contributions”) to the Site, you agree to the following:
License Grant.
You hereby grant South African Universities and its affiliates a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, fully sublicensable right and license to use, reproduce, distribute, display, perform, modify, adapt, translate, publish and otherwise exploit your Contributions, in whole or in part, in any form, medium or technology now known or later developed, without compensation to you or any third party.
• Representation and Warranty.
You represent and warrant that:
1. You own or control all rights, titles and interests in and to your Contributions, including all necessary rights to grant the foregoing license.
2. Your Contributions are original to you and do not infringe, misappropriate or violate any intellectual property, privacy, publicity, contractual or other rights of any person or entity.
3. Your Contributions comply with these Terms and all applicable laws.
• No Obligation and Editorial Discretion.
We are under no obligation to:
৹ Post, publish or use your Contributions in any way;
৹ Pay you for any use of your Contributions;
৹ Retain any specific Contribution or maintain it in confidence.
• Right to Remove or Modify.
We reserve the right, in our sole discretion and without prior notice, to edit, reject or remove any Contribution for any reason, including—and not limited to—violations of these Terms.
• Moral Rights; Waiver.
To the extent permitted by applicable law, you waive and agree not to assert any “moral rights” or “droit moral” in or to your Contributions against South African Universities or its licensees.
• Indemnification.
You agree to indemnify, defend and hold harmless South African Universities and its officers, directors, employees and agents from and against any and all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or related to your Contributions or your breach of these representations and warranties.
Your Contributions are non-confidential and non-proprietary. By submitting them, you acknowledge that any ideas, suggestions or proposals contained therein may be used by us for any purpose without restriction or attribution.
8. Third-Party Links
The Site may include links, banners, or references to third-party websites, services, applications or resources (“Linked Sites”). These Linked Sites are provided solely for your convenience and do not imply any endorsement, sponsorship or affiliation by South African Universities.
• No Control or Endorsement.
We do not monitor, review or approve the content, products, services, privacy policies or business practices of any Linked Site. Inclusion of a link does not constitute an endorsement or recommendation by us.
• Your Responsibility.
Your access to and use of any Linked Site is entirely at your own risk. You should evaluate the suitability, security and legality of each site before you access or use it, and you agree that South African Universities has no liability for your interactions with, or the content of, any Linked Site.
• Separate Terms and Policies.
Third-party sites may have different terms of use, privacy policies and security practices. You should review and understand those terms and policies—and any applicable fees—before using any Linked Site.
• No Liability.
To the fullest extent permitted by law, South African Universities disclaims all warranties and liability arising out of or relating to any Linked Site, including but not limited to:
৹ Availability, functionality or uptime of the site;
৹ Accuracy, completeness or legality of content or materials;
৹ Any losses, damages or injuries resulting from your use of, or reliance on, the Linked Site.
Your decision to visit or interact with Linked Sites is voluntary, and you agree that South African Universities will not be responsible for any loss or damage incurred as a result.
9. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. SOUTH AFRICAN UNIVERSITIES HEREBY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
• Merchantability. No warranty that the Site or its content will meet your needs or be fit for any particular purpose.
• Fitness for a Particular Purpose. No warranty that the Site is suitable for your specific academic, professional or personal objectives.
• Title and Non-Infringement. No warranty that your use of the Site will not infringe the rights of third parties.
Additionally, SOUTH AFRICAN UNIVERSITIES MAKES NO WARRANTY THAT:
Your Use Is at Your Own Risk.You assume full responsibility for the selection of the Site to achieve your intended results, and for the installation, use and results obtained from the Site. Some jurisdictions do not allow the exclusion of implied warranties; in such cases, the foregoing disclaimers apply only to the extent permitted by law.
10. Limitation of Liability
To the fullest extent permitted by applicable law, South African Universities, its affiliates and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to lost profits, lost data, business interruption or loss of goodwill, arising out of or in connection with your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend and hold harmless South African Universities and its officers, directors, employees, agents and licensors from and against any and all claims, demands, actions, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees and court costs) arising out of or in connection with:
• Your breach or alleged breach of these Terms;
• Your use of or inability to use the Site;
• Any Contributions, content or materials you submit to the Site;
• Your violation of any rights of a third party, including intellectual property, privacy or publicity rights;
• Your violation of any law, rule or regulation.
We reserve the right, at our expense and in our sole discretion, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.
12. Termination
South African Universities may, in its sole discretion and without prior notice, suspend or terminate your access to the Site (or any part thereof) at any time and for any reason, including but not limited to your violation of these Terms. Upon suspension or termination:
• Your right to access and use the Site will immediately cease.
• South African Universities may delete or disable your account and all related information and files in your account.
• Sections of these Terms that by their nature should survive termination (including, without limitation, Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification and Miscellaneous provisions) will continue in full force and effect.
You acknowledge that South African Universities will not be liable to you or any third party for any suspension or termination of your access.
13. Governing Law and Jurisdiction
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict-of-law principles. You agree that any dispute, claim or controversy arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Durban, South Africa, and you hereby submit to the personal jurisdiction of those courts.
14. Changes to Terms
South African Universities reserves the right to modify or revise these Terms at any time in its sole discretion. When we do, we will update the “Effective Date” displayed at the top of this page. Your continued access to or use of the Site following the posting of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must immediately discontinue use of the Site.
